I may collect the following personal data when you interact with this Website or my services:

•        Full name

•        Email address

•        Phone number (where provided voluntarily)

•        Information submitted through enquiry, contact, or booking forms on this Website

•        Any personal information you voluntarily share in correspondence, consultations, coaching sessions, or programme content

•        Information provided through surveys, giveaways, customer support requests, or marketing opt-ins

Kajabi Account Information

My programmes and digital products are hosted and delivered through Kajabi (kajabi.com). When you purchase or enrol in a programme, you will be directed to a Kajabi checkout page where you will create a Kajabi account by providing an email address, password, and payment details. This account is created on and managed by Kajabi’s platform, which operates under its own Privacy Policy and Terms of Service (available at kajabi.com/privacy). I receive certain account details (such as your name and email address) as part of delivering my services to you, but your Kajabi login credentials and full payment card details are held by Kajabi and its payment processors, not by me.

Payment Information

If you purchase a programme or product, payment is processed via the Kajabi checkout page, which uses third-party payment processors (including Stripe and/or PayPal). I do not directly collect or store your full payment card details. The only payment-related information I receive is the name associated with your payment method and basic transaction details (such as the date, amount, and programme purchased). Full card data is handled entirely by the relevant payment processor. Please refer to Stripe’s Privacy Policy (stripe.com/gb/privacy) and/or PayPal’s Privacy Policy (paypal.com/uk/webapps/mpp/ua/privacy-full) for details of how your payment data is stored and protected.

Health and Wellness Information (Special Category Data)

I may ask you to share information relating to your health, wellbeing, or lifestyle in the course of delivering my services. Under UK GDPR and EU GDPR, health-related data is classified as “special category data” and is subject to additional legal protections. I will only collect, process, and retain health-related information with your explicit consent, which you may withdraw at any time; or where it is necessary for the performance of our coaching agreement and is handled with appropriate safeguards.

Automatically Collected Data

Each time you visit this Website and this Service, we automatically collect certain information about your device and your interaction with the Website and Service. This may include your viewing activity, your IP address, approximate location information, your browser type, your Internet service provider (ISP), referring/exit pages, your operating system, date/time stamps, and related metadata.

Legal Basis for Processing

Under UK GDPR (and EU GDPR where applicable), I must have a lawful basis for processing your personal data. The legal bases I rely on are:

  • Contractual necessity: Processing is necessary to perform a contract with you or to take steps at your request before entering into a contract (e.g. delivering coaching services you have enrolled in).

  • Legitimate interests: Processing is necessary for my legitimate business interests such as responding to enquiries, improving the Website, and communicating with prospective clients where those interests are not overridden by your rights and freedoms.

  • Consent: Where I have requested and received your explicit consent, including for marketing emails and for processing special category health data. You may withdraw consent at any time by contacting me at support@karlyarber.com.

  • Legal obligation: Where processing is necessary to comply with a legal obligation applicable to me.

Emails

I send two types of emails: transactional emails and marketing emails. These are treated differently under data protection law.

Transactional emails: When you make a purchase or sign up for a service, we may send you a welcome when you enrol in a service or create a Kajabi account. If you make a purchase we may send you an email confirming your purchase. We may also send you other emails concerning your account status, access or renewals. You cannot opt out of transactional emails while you remain an active client, as they are necessary to deliver the service.

Marketing emails: Depending on your preferences, we may send you emails letting you know about new programmes, features, offers or other promotional communications. You may opt out of these emails at any time in your account settings. My email marketing is managed by Kajabi and Flodesk. Please  review those platform’s privacy policy for information on how your email data is stored and processed. Opting out from marketing emails will not affect transactional communications sent in connection with an active programme or purchase.

Third Party Processors and Service Provides

To operate my business and deliver my services, I use the following third-party tools and service providers. Each acts as a data processor on my behalf and is subject to data processing agreements or equivalent contractual safeguards:

Kajabi (kajabi.com): Used to host and deliver online programmes, manage client access, process programme purchases, and send email communications. Kajabi acts as both a data processor (on my behalf) and an independent data controller (for transactions processed through its platform). Privacy policy: kajabi.com/privacy.

Stripe (stripe.com) and/or PayPal (paypal.com): Payment processing for programme purchases is handled through Kajabi’s checkout, which uses Stripe and/or PayPal. I do not store your full payment card details. Privacy policies: stripe.com/gb/privacy and paypal.com/uk/webapps/mpp/ua/privacy-full

Meta Platforms (Instagram / Facebook Pixel): This Website may use the Meta Pixel, a tracking technology that collects data about your activity on this Website and may link it to your Meta profile where applicable. This is used to measure advertising effectiveness, retarget Website visitors, and understand audience behaviour. You can opt out via your Meta account settings or by managing your cookie preferences on this Website.

Website Hosting Provider: Squarespace. Your use of this Website is also subject to the hosting provider’s data practices. Please refer to their privacy policy for further information.

International Data Transfers

Some third-party service providers I use (including Kajabi, Stripe, Meta, and Flodesk) may store or process your data outside of the United Kingdom or European Economic Area (EEA). Where this occurs, I ensure that appropriate safeguards are in place, including:

  • UK International Data Transfer Agreements (IDTAs) or EU Standard Contractual Clauses (SCCs) where applicable;

  • Adequacy decisions made by the UK Government or European Commission recognising the destination country as providing adequate data protection; or

  • The provider’s own binding corporate rules or equivalent legally recognised safeguards.

How Long I Keep Your Data

I retain personal data only for as long as necessary to fulfil the purpose for which it was collected, or as required by applicable law. As a general guide:

  • Client records: Retained for a minimum of 6 years after the conclusion of our working relationship, in line with UK limitation periods for contractual claims.

  • Enquiry and contact form data: Retained for up to 12 months unless a client relationship is formed, in which case the above applies.

  • Marketing email data: Retained until you unsubscribe or request deletion, whichever is earlier.

  • Financial and transaction records: Retained for 6 years in accordance with HMRC requirements.

Your Rights

Under UK GDPR (and EU GDPR where applicable) you have the following rights in relation to your personal data:

  • Right of access: You may request a copy of the personal data I hold about you (a Subject Access Request).

  • Right to rectification: You may request that I correct any inaccurate or incomplete personal data I hold about you.

  • Right to erasure: You may request that I delete your personal data in certain circumstances (the “right to be forgotten”). You can also delete your Kajabi account directly through your account settings, though this may result in loss of access to purchased content.

  • Right to restrict processing: You may request that I limit the way I use your personal data in certain circumstances.

  • Right to data portability: You may request to receive your personal data in a structured, machine-readable format and to transfer it to another controller where technically feasible.

  • Right to object: You may object to processing based on legitimate interests or carried out for direct marketing purposes.

  • Rights related to automated decision-making: You have the right not to be subject to decisions made solely by automated means where those decisions have a legal or similarly significant effect on you.

  • Right to withdraw consent: Where processing is based on consent, you may withdraw that consent at any time without affecting the lawfulness of processing carried out before withdrawal.

To exercise any of these rights, please contact me at support@karlyarber.com or via the contact form at www.karlyarber.com/contact. I will respond within one calendar month of receiving your request. There is no charge for standard requests; however, I reserve the right to charge a reasonable fee or decline requests that are manifestly unfounded or excessive.

Please note that I may retain certain information to comply with legal obligations or for reactivation purposes if requested.
